Beta Terms of Service & Early Access Agreement
Special terms governing pre-release access, beta software testing, feedback rights, and mandatory post-registration acceptance for early users of omniHR.
LEGAL NOTICE & CUSTOMIZATION ADVISORY
This policy contains baseline provisions tailored for a B2B Human Resource Management System (HRMS) handling payroll, biometric attendance, tax, and employee records under India's Digital Personal Data Protection Act, 2023 (DPDPA) and global privacy frameworks (including GDPR). Bracketed values such as [COMPANY_NAME], [PRIVACY_EMAIL], and statutory grievance officer details must be verified by qualified legal counsel prior to commercial execution.
If your organization registered or accessed omniHR prior to the formal publication of our legal center on 26-09-2026, continued access to your workforce workspace requires affirmative acceptance of these Beta Terms and our Master SaaS Agreement.
These Beta Terms of Service ("Beta Terms") constitute a binding contract between omniHR Technologies Private Limited ("omniHR", "we", "us") and the organization or individual participating in our pre-release, beta, or early-adopter access programs ("Customer", "Beta Tester", "you").
The Service encompasses experimental HRMS modules (including AI Face Recognition Attendance, geofenced clock-in, automated payroll calculation, and IT asset tracking) that may contain bugs, experience unexpected latency, or undergo rapid architectural modifications.
As a participant in the omniHR Beta Program, you agree to:
- Maintain strict administrative credential security and prevent unauthorized access to your tenant workspace;
- Ensure that all employee personal and compensation data uploaded satisfies applicable privacy notice and consent mandates under India's Digital Personal Data Protection Act, 2023 (DPDPA) and GDPR;
- Independently verify automated payroll, tax deduction, and overtime outputs before disbursing actual employee wages or filing statutory government tax returns;
- Promptly report any suspected software bugs, calculation discrepancies, or security concerns to our engineering team.
We actively solicit suggestions, error reports, and feature enhancement proposals ("Feedback"). You agree that omniHR shall own all right, title, and interest in and to any Feedback submitted, without any obligation of compensation, royalty, or attribution.
You retain 100% ownership of your proprietary employee master data, attendance punch logs, and compensation inputs uploaded to your private workspace.
Notwithstanding the pre-release nature of the software, all employee personal data uploaded during the beta period remains protected under enterprise-grade technical safeguards (AES-256 encryption at rest, TLS 1.3 in transit, and logical tenant isolation) as governed by our Data Processing Agreement (DPA) and Master Privacy Policy.
Beta Testers agree not to publicly disclose unreleased UI designs, proprietary feature workflows, or performance benchmark results without prior written authorization from omniHR.
omniHR reserves the right to modify, suspend, or discontinue any beta feature, endpoint, or workflow at any time without prior notice. While we strive for high availability, our formal 99.9% Service Level Agreement (SLA) does not apply to features explicitly marked as "Experimental" or "Beta".
Upon the conclusion of the beta preview period for specific modules, omniHR will provide at least [30 days] advance notice outlining commercial subscription tiers, early-adopter discount pricing, and migration procedures.
Beta Testers who elect not to transition to a paid subscription will be provided [30 to 60 days] to export all employee records and payroll archives before accounts are transitioned to a free tier or scheduled for deletion per our Data Retention Policy.
THE BETA SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS. TO THE MAXIMUM EXTENT PERMITTED UNDER LAW, OMNIHR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND SYSTEM STABILITY.
IN NO EVENT SHALL OMNIHR BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF DATA OR PAYROLL DISCREPANCIES) ARISING OUT OF YOUR USE OF THE BETA SOFTWARE.
Either party may terminate participation in the Beta Program at any time with or without cause upon written notice. Upon termination, Customer may export all employee records through the administrative portal.
These Beta Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising hereunder shall be resolved through binding arbitration in Bangalore, India under the Arbitration and Conciliation Act, 1996.
